Official Rules
1. SPONSOR: Sweepstakes is sponsored by Lafonn LLC, 6721 Katella Avenue, Cypress, CA 90630 (“Sponsor”). Sweepstakes is not sponsored, endorsed or administered by, or associated with Meta Platforms, Inc. (“Instagram”). Lafonn® is a registered trademark of Lafonn LLC.
2. NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. A PURCHASE OF ANY KIND DOES NOT IMPROVE YOUR CHANCES OF WINNING. ALL FEDERAL, STATE AND LOCAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED OR RESTRICTED BY LAW. THIS SWEEPSTAKES IS OPEN ONLY TO LEGAL RESIDENTS OF THE FIFTY UNITED STATES AND THE DISTRICT OF COLUMBIA (EXCLUDING RESIDENTS of OVERSEAS MILITARY INSTALLATIONS, PUERTO RICO, and OTHER US TERRITORIES) GOVERNED BY UNITED STATES LAWS AND REGULATIONS.
3. ELIGIBILITY: The Lafonn LLC Sparkle & Shine Giveaway (the “Sweepstakes”) is open only to legal residents of the Fifty United States and the District of Columbia (excluding residents of overseas military installations, Puerto Rico, and other US territories) who was at least 18 years of age at time of entry, except employees, contractors, representatives or agents (and those with whom such persons are domiciled, if related) of Lafonn LLC (the “Sponsor”). Employees of Sponsor and their subsidiaries, affiliates, advertising, and promotion agencies, and their immediate family members (spouse, parent, child, sibling, and their respective spouses, regardless of where they reside) are not eligible to enter the Sweepstakes. Sweepstakes is subject to all applicable local, federal laws and regulations. By participating in this Sweepstakes, you agree to be legally bound by the terms and conditions of these Official Rules and Regulations (the “Rules”). Void where prohibited by law. No purchase necessary.
4. AGREEMENT TO OFFICIAL RULES: By participating in the Sweepstakes, the entrant (“you” or “You” or “Entrant”) fully and unconditionally agrees to the terms and conditions of these Rules and the decisions of the Sponsor, which are final and binding in all matters related to the Sweepstakes. By entering, you represent and warrant that you meet the eligibility requirements.
5. ENTRY PERIOD: Sweepstakes begins Wednesday, May 8, 2024 at 9:00 a.m. Pacific Daylight Time (PDT) and ends Wednesday, May 15, 2024 at 5:00 p.m. PDT (the “Entry Period”). All times determined by Sponsor’s clock. If you are entering the sweepstakes using a mobile device, standard data charges from your phone carrier may apply.
6. HOW TO ENTER: A valid personal Instagram account is required to enter the Sweepstakes. Creating an Instagram account is free. Instagram terms and conditions will apply. See https://instagram.com/about/legal/terms/.
Persons who meet the eligibility requirements and have read and accepted these Official Rules may enter by taking these steps. To enter:
a. Follow @Lafonn on Instagram.
b. Like the giveaway post and comment on the giveaway post.
c. In the comment, tag a friend. Each comment counts as an additional entry; there is no limit. The more you TAG the more entries you get.
d.Your comment(s) with a tag(s) is your entry, and you must be following @Lafonn on Instagram.
There is no limit on entries during the Entry Period. Sponsor is not responsible for late, lost, damaged, illegible stolen, incomplete, or misdirected Entrants. Proof of entrant will not be deemed to be proof of receipt by Sponsor.
Three (3) prize winners will be announced in the comments around 9:00 a.m. PDT on Friday, May 17, 2024. Prize winners must respond by 12:00 p.m. PDT on Tuesday, May 21, 2024. See details in paragraph 10 below.
7. TERMS & CONDITIONS:
a. Sponsor reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Sweepstakes should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. In such case, Sponsor may select the recipients from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsor. Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or website or violates these Terms & Conditions.
b. Sponsor has the right, in its sole discretion, to maintain the integrity of the Sweepstakes, to void entries for any reason, including, but not limited to; multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by sweepstakes rules; or the use of bots, macros or scripts or other technical means for entering.
c. Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the sweepstakes may be a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.
d. Entries may not contain, and Sponsor may remove or disqualify in its sole discretion at any time, any entry containing content it deems inappropriate or unsuitable. This includes, without limitation, contents that are offensive, indecent, profane, obscene, hateful, illegal, tortious, defamatory, lewd, misleading, derogatory, violent, threatening, or harassing.
e. Any use of robotic, automatic, programmed or the like entry methods will be disqualified, and the submission removed at the sole discretion of Sponsor.
f. Entries must be suitable for public viewing by all ages and in keeping with Sponsor’s image.
g. Sponsor may disqualify or remove entries at any time in its sole discretion.
8. WINNER PRIZES & APPROXIMATE RETAIL VALUE: Three (3) winners will be selected. Each winner will receive one (1) piece of Lafonn jewelry of up to ARV $250 of their choice. Prize may not be transferred, substituted or redeemed for cash. All prizes awarded “AS IS”. Winner is responsible for all taxes on prize and will provide taxpayer information to Sponsor upon request.
9. WINNER SELECTION: Winners will be selected on a random basis. Three (3) prize winners will be announced on a comment in the original Instagram post around 9:00 a.m. PDT on Friday, May 17, 2024. No individual may win more than one (1) prize in the Sweepstakes.
10. WINNER NOTIFICATION:
a. The potential winners will be announced on a comment in the original Instagram post around 9:00 a.m. PDT on Friday, May 17, 2024. It is the sole responsibility of potential winners to direct message Lafonn and must direct message Lafonn by 12:00 p.m. PDT on Tuesday, May 21, 2024, providing a full name, mailing address, email address and phone number.
b. The potential winner must return the completed and signed Declaration of Compliance and Release Form by 12:00 p.m. PDT on Friday, May 24, 2024. If the potential winner does not respond in time, does not return the completed and signed Declaration of Compliance and Release Form in time, is ineligible, or does not comply with these Official Rules for any reason, or prize or prize notification is returned as undeliverable, the potential winner will be disqualified and forfeits any prize, and an alternate potential winner will be selected in the same manner.
11. USE OF ENTRIES: BY submitting an entry, each entrant grants to Sponsor and all of its officers, directors, employees, affiliates, agents and successors and assigns (“Sponsor Entities”), without further consideration, the perpetual, worldwide, fully-paid, irrevocable, right and license to use, reproduce, distribute, modify, create derivative works based upon, and promote, the entry and Instagram handle, in Instagram or any other media, whether known or hereinafter discovered, for any use whatsoever, free of any claim. Entrants waive any right to inspect or approve such uses. Sponsor is under no obligation to post or use any entry. Entrant represents and warrants that the entry is original to entrant, does not include the trade secrets or confidential information of others, and does not infringe the rights of others. Entrant is solely responsible for his/her entry.
12. LIMITATION OF LIABILITY: By entering you agree to release and hold harmless Sponsor and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant's participation in the sweepstakes and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error which may occur in the administration of the Promotion or the processing of entries.
13. PRIVACY: Unless otherwise stated in these Official Rules, all personal information collected in connection with Sweepstakes is subject to Sponsor’s privacy policy at: https://www.lafonn.com/pages/privacy-and-disclaimer. By entering Sweepstakes, entrants agree to be contacted by Sponsor for potential winner notification and that their name and Instagram handle may be used in announcing Sweepstakes winner on Instagram and elsewhere.
14. DISPUTES: THIS SWEEPSTAKES IS GOVERNED BY THE LAWS OF UNITED STATES OF AMERICA AND STATE OF CALIFORNIA, COUNTY OF ORANGE, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Sweepstakes, Entrant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in State of California, County of Orange, having jurisdiction. Further, in any such dispute, under no circumstances will Entrant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than Entrant's actual out-of-pocket expenses (i.e. costs associated with entering this Sweepstakes), and Entrant further waives all rights to have damages multiplied or increased.
15. WINNER LIST. For a list containing the names of the winners, send a self-addressed stamped envelope with your request to Lafonn, 6721 Katella Avenue, Cypress, CA Attention: Sparkle & Shine Sweepstakes. Requests must be received by May 31, 2024.
